End User License Agreement

Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you (the "User") and TOWER MIND RUSH LTD ("we," "us," or "our") for the Tower Mind Rush software application, including all associated content, audio, and documentation ("Software").

By installing, downloading, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

Important: By using Tower Mind Rush, you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy.

License Grant

TOWER MIND RUSH LTD grants you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use the Software on one or more Apple-branded devices that you own or control, for your personal, non-commercial use only.
• Access all bundled content — including guided practices, audio loops, bell cues, and journaling prompts — within the Software in accordance with this EULA.

License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the Software or its bundled content.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Software.
• Remove, alter, or obscure any proprietary notices, labels, or copyright marks in or on the Software.
• Use the Software or any part of it for any commercial purpose, including resale or redistribution, without prior written authorization.
• Use automated systems, scripts, or bots to interact with the Software.
• Use the Software in any manner that violates applicable law or regulation.

Intellectual Property

The Software is licensed, not sold. TOWER MIND RUSH LTD retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to any trademarks or service marks of TOWER MIND RUSH LTD.

• We own: all software code, design, artwork, illustrations, practice content, audio assets, text, branding, and any other content included in the Software.
• You own: any personal journal entries, mood logs, and other user-generated content you create using the Software. This data resides exclusively on your device.

User Data and Privacy

Tower Mind Rush stores all user data (journal entries, mood history, practice preferences, streaks, and reminder settings) exclusively on your device using local storage. We do not collect, access, or transmit your personal data to any server. Your use of the Software is also governed by our Privacy Policy.

No Account Required

Tower Mind Rush does not require account registration and has no online account or subscription system. All features are available immediately upon installation without any sign-up. There are no in-app purchases or subscription fees associated with this Software.

Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOWER MIND RUSH LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DEFECTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOWER MIND RUSH LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR BUSINESS INTERRUPTION.

Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete all copies from your devices.

Apple App Store Additional Terms

The Software is made available through the Apple App Store. You acknowledge and agree that:

• Apple has no obligation to provide any maintenance or support services for the Software.
• Apple is not responsible for any product warranties, claims, or liability related to the Software.
• Apple is a third-party beneficiary of this EULA and may enforce it against you.
• Your use of the Software must comply with the Apple App Store Terms of Service.

Updates and Modifications

TOWER MIND RUSH LTD may provide updates or modifications to the Software via the App Store. We reserve the right to modify this EULA at any time. Continued use of the Software after any changes constitutes your acceptance of the modified EULA.

Governing Law

This EULA shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration or in the courts of competent jurisdiction as applicable.
